MINUTES OF PUBLIC MEETING

FOR CORRECTIONS OFFICER RETIREMENT PLAN LOCAL BOARD

ARIZONA DEPARTMENT OF CORRECTIONS

A Public meeting of the Corrections Officer Retirement Plan Local Board for the Department of Corrections was convened, Thursday, April 21, 2005, at 9:00 a.m., in the Occupational Licensing Building, 1645 West Jefferson, Fourth Floor Conference Room, Phoenix, Arizona.

Present at the meeting were the following individuals:

I. Call to Order - Local Board meeting called to order by M. Smarik, Acting Chair, at 9:10 a.m., Thursday, April 21, 2005.

II. Approval of Minutes

a. Approval of the February 22, 2005, Executive Session Minutes. - A motion for approval was made by B. Rollins. Seconded by R. Burgher. Approved.

b. March 24, 2005, Public Session Minutes - Tabled pending correction of Section VII (a). Minutes will be corrected and submitted for approval at the next meeting.

III. Disability Retirement - The Local Board may consider and vote on the following disability applications. The Board may defer decision to a later date. The Local Board may vote to discuss these applications in Executive Session pursuant to A.R.S 38-431.03 (A)(2) and obtain legal advice pursuant to A.R.S 38-431.03 (A) (3).

IV. The Local Board may consider and vote on the following applications for Normal Retirement in public meeting or defer decision to a later date. A motion for approval of the following (18) Normal Retirement Applications (a - r) was made by B. Rollins. Seconded by J. Hood. Unanimously approved.

V. Survivor Benefit - The Local Board may consider and vote on the following applications for Survivor Benefits in public meeting or defer decision to a later date.

a. Richard Ficken (Lisa) - A motion for approval was made by R. Burgher. Seconded by B. Rollins. Unanimously approved.

VI. Guardian Child(s) Benefit - The Local Board may consider and vote on the following applications for Guardian Child(s) Benefits in the public meeting or defer decision to a later date.

a. Stephen J. Tarin - (Stephen J. Tarin) - Tabled - Pending written clarification from the Fund Manager regarding interpretation of CORP Statutes relating to eligibility.

General Discussion - Sections c & e

Current Board practice regarding Waivers - The Local Board discussed the feasibility of continuing the current Board procedure used for granting waivers to remain in CORP and ASRS and the need to define the term “temporary fill” as referred to in statute relating to waivers. HRD Administrator, Pam Christofferson, brought to the attention of the Board that while looking to define “temporary fill” the Board may also, want to consider defining “transfer.” Acting Chair, M. Smarik, stated that Board needs to set some standard for “temporary.” It was determined that Board members would come up with definitions and submit them to the Board Secretary to be compiled, copied and distributed at the next meeting.

VII. Request to Remain in ASRS/CORP - The Local Board may consider and vote on the following Job Classifications in the Public Meeting or defer decision to a later date.

a. Idalia Alicia (CORP) - Tabled.

b. Shawn O’Connor (CORP) - Tabled.

VIII. General Discussion - The Local Board may consider and vote on the following Job Classifications in Public Meeting or defer decision to a later date.

a. Class Code 73114 - Program Proj. Specialist I - Pending - At ADOA as of 3/17/05 - Tabled.

b. Class Code 73115 - Program Proj. Specialist II - Pending - At ADOA as of 3/17/05 - Tabled.

It was determined by members of the Local Board, only Job Classifications which have received final approval from ADOA should be presented for Board action.

f. Projected Retirement Stats - A report of eligible retirees was reviewed by the Board.

g. S.B. 1426 “Overtime” - Currently before the Legislature regarding allowing retirement contributions to be taken on overtime. Distributed.

IX. Call to Public

The Chair adjourned the meeting at 11:09 a.m.
