MINUTES OF PUBLIC MEETING FOR CORRECTIONS OFFICER RETIREMENT PLAN LOCAL BOARD ARIZONA DEPARTMENT OF CORRECTIONS A Public meeting of the Corrections Officer Retirement Plan Local Board for the Department of Corrections was convened, Thursday, May 25, 2006, at 9:00 a.m., in the Human Services Building, 1831 West Jefferson, Second Floor Conference Room, Phoenix, Arizona. Present at the meeting were the following individuals:
I. Call to Order – Local Board meeting called to order by P. Scherden, Chair, at 9:01 a.m., Thursday, May 25, 2006. The Chair requested the Local Board enter Executive Session to discuss disability application #05-03. EXECUTIVE SESSION: 9:03 a.m. PUBLIC SESSION RESUMED: 9:30 a.m. II. Approval of Minutes a. April 26, 2006, Public Meeting Minutes – A motion for approval was made by B. Rollins. Seconded by R. Burgher. Approved. III. Disability Retirement – The Local Board may consider and vote on the following disability applications in Public Session or the Board may defer this decision to a later date. The Local Board may vote to discuss these applications in Executive Session pursuant to A.R.S. 38- 431.03 (A)(2) and obtain legal advice pursuant to A.R.S. 38-431-03 (A)(3). a. #05-03 – Rehearing – A motion to reconsider application #05-03 was made by R. Burgher. Seconded by P. Christofferson. Approved. A second independent medical evaluation conducted by Dr. Thrasher on May 12, 2006, which was based upon additional medical records provided by the applicant was received and considered by the Local Board. Upon review of this evaluation, it was determined the applicant meets the criteria for an Accidental Disability. R. Burgher motioned the board approve application #05-03. Seconded by P. Christofferson. B. Rollins requested, in addition to the motion for approval, an annual re-evaluation be required. The original motion was amended by R. Burgher to approve an Accidental Disability benefit with an annual re-evaluation requirement. Seconded by P. Christofferson. Approved. IV. Normal Retirements – The Local Board may consider and vote on the following applications for Normal Retirement in public meeting or defer decision to a later date. A motion for approval of the following (6) Normal Retirement Applications (a – f) was made by B. Rollins. Seconded by P. Christofferson. Approved. a. Edward M. Berry b. Lloyd C. Boston c. Bobby G. Hammett d. Anthony M. Haynes e. Robert S. Miranda f. Rudy R. Robles V. Survivor Benefit – The Local Board may consider and vote on the following application for Survivor Benefits in public meeting or defer decision to a later date. A motion to approve the following (1) Survivor Benefits for application (a) was made by R. Burgher. Seconded by B. Rollins. Approved. a. Jerry Gordon (Henrietta) VI. Death Benefit – The Local Board may consider and vote on the following application for Survivor Benefits in the public meeting or defer decision to a later date. Chairman noted for the record. a. Elvira M. Long (Ricardo Montano) VII. Request to Remain in ASRS/CORP – The Local Board may consider and vote on the following Requests to Remain in ASRS/CORP in the Public Meeting or defer decision to a later date. a. Kenneth R. Bowers (CORP) – A motion for approval was made by B. Rollins. Seconded by R. Burgher. R. Burgher noted that the applicant does have a mobility assignment agreement on file with a termination date of 2008. The original motion was amended by B. Rollins that the application to remain in CORP be approved consistent with the duration of his mobility assignment. Seconded by R. Burgher. Approved. b. Dolores Herrera (ASRS) – A motion for approval, due to the fact that the request meets the criteria stated in A.R.S. section 38-891, (F), was made by B. Rollins. Seconded by P. Christofferson. Approved. c. Polly Putnam (ASRS) – A motion for approval, due to the fact that the request meets the criteria stated in A.R.S. section 38-891, (F), was made by R. Burgher. Seconded by P. Scherden. Approved. d. Daniel B. Town (CORP) – A motion for approval, due to the fact that the request meets the criteria stated in A.R.S. section 38-891, (E), was made by R. Burgher. Seconded by P. Christofferson. Approved. VIII. CORP Job Class – The Local Board may consider and vote on the following Job Classifications in the Public Meeting or defer decision to a later date. A motion was made by R. Burgher to approve classifications (a – c). Seconded by B. Rollins. Discussion followed and R. Burgher withdrew his motion for classifications (a – c). B. Rollins withdrew his second. A new motion was made by R. Burgher to approve classifications (a – b) as CORP designated positions. Seconded by P. Christofferson. Approved. a. DC Corrl Lieutenant (Job Code AUN07337 uncovered) – see motion above. Approved. b. DC Corrl Officer IV (Job Code AUN07338 uncovered) – see motion above. Approved. c. DC Education Admr (Job Code AUN07324 uncovered) – A motion was made to deny this classification as a CORP designed position. Seconded by P. Christofferson. Denied. IX.
