Notice of Victim's Right to
Request Not to Receive Inmate Mail
Pursuant to A.R.S. 13-4411.01
which is effective from and after January 29, 2000, Victims may request NOT to
receive inmate mail and the Department shall not knowingly forward mail
addressed to any person who requests not to receive mail pursuant to this
section.
The victim's request must be indicated on a Post-conviction request form and
submitted to the Central Office Offender Information, Release Notification
Services Unit.
The Central Office Offender Services Bureau Administrator shall:
- Ensure acknowledgment of all requests from Victim's requesting not to
receive mail from the inmate is provided to the Warden and the Victim.
- Ensure tracking of the victims request is maintained on the AIMS computer
system.
- Ensure, upon receipt of the victim's request, written notice is provided
to the Warden.
- Provide, if necessary, training to staff on reviewing AIMS screens
applicable for obtaining the victim's request.
The Institution and Private Contract Facility Wardens shall:
- Ensure the inmate is notified of the request
- Ensure the inmate is informed that sending mail to the victim, or the
family or household members who are denoted by the victim, shall result in
appropriate sanctions, including reduction or denial of Earned Release
Credits.
- Ensure the appropriate staff (i.e., CO
II, Mail Room, Etc.) are notified
of the request.
- Ensure the appropriate institution staff (i.e. Mail Room) are trained in
the review of AIMS screens and/or maintain a tracking mechanism for ensuring
mail is not forwarded to the victim.
- Ensure appropriate disciplinary action, violation of Group B23, is taken
against an inmate who is caught in violation of this statute.
- Ensure, upon receipt of notice that an inmate has violated this statute, a
review is made of all of the inmate's outgoing mail to further ensure that
no additional correspondence is sent to the victim or to the victim's family
or household members who have requested not to receive inmate mail.
