SUBJECT: Director's Instruction #125, Protective Segregation (PS) Conditions of Confinement for Approved and Pending PS Cases

Effective immediately, remove DI #125, Protective Segregation (PS) Conditions of Confinement for Approved PS Cases dated August 21, 2001 and replace with this Director's Instruction.

1.0 PURPOSE AND SCOPE: To provide instructions for field locations regarding conditions of confinement for approved protective segregation (PS) inmates. This instruction provides information on two general categories of inmates: Those confined in Level 5 facilities and those confined in Level 4 and lower facilities.

1.1 Inmates in PS require special handling to assure their safety. Wardens shall institute all necessary operational safeguards to assure these conditions are met.

1.1.1 Approved PS cases shall be maintained in separate housing and program areas at all times. Complete physical and visual separation shall be maintained at all times.

1.2 PS is not a punitive status. Even in a Level 5 setting, all approved PS inmates shall be afforded access to programs and services comparable to those available to general population (GP) inmates in the same custody classification. Wardens shall institute operational procedures to assure program equivalence, to the extent permitted by legitimate security and physical plant considerations.

2.0 AUTHORITY: A.R.S. §41-1604, Duties and Powers of the Director.

3.0 RESPONSIBILITY: Assistant Directors, Wardens, Deputy Wardens, Administrators, shall ensure compliance with the provisions of this order.

4.0 APPLICABILITY: This order applies to Assistant Directors, Wardens, Deputy Wardens, Administrators, and all staff in all facilities.

5.0 THE ORDER: Protective Segregation inmates shall be afforded conditions of confinement per DO 804 and DO 909, unless otherwise noted below.

For the purpose of this order the following terms will be used:

I-5 inmates - This term will apply to all PS inmates with an I-5 score regardless of P score and location.

Non I-5 inmates - This term will apply to all PS inmates housed in a Level 5 facility who have been approved for double bunking by the unit Deputy Warden.

Level 4 inmates - This term will apply to all inmates housed in designated Level 4 PS facilities.

Level 3 inmates - This term will apply to all inmates housed in designated Level 3 PS facilities.

5.1 To be approved to Double Bunk the inmate must meet all of the following:

5.1.1 I score of 4 or below.

5.1.2 MH score of 3 or below, or approval from Mental Health staff.

5.1.3 No discipline for a serious assault on staff or inmates in the last 2 years.

5.2 The Deputy Warden, with approval of the Warden, may deem an inmate inappropriate for double bunking based on the following:

5.2.1 History of being assaulted

5.2.2 History of assaulting other inmates

5.2.3 Extensive DNHW list.

5.2.4 STG affiliations

5.2.4.1 STG Debriefed inmates must sign a Double-Bunk Acknowledgment/Consent form prior to being double bunked.

5.2.4.2 Non STG Debriefed inmates must agree prior to being double bunked with an STG Debrief inmate.

5.3 Mail/Store/Property Privileges

5.3.1 I-5 inmates are allowed SMU/SMA Inmate Mail/Store/Property privileges commensurate with DO 909. (Refer to DO 909, Attachment A)

5.3.2 Non I-5 inmates housed in a double bunk setting shall receive property and store privileges commensurate with other Level 5 inmates as specified in DO 909. Single celled non-I5 inmates will receive mail and property privileges commensurate with other SMU inmates, as specified in DO 909.

5.3.3 Level 3 and 4 inmates are allowed Inmate Mail/Store/Property privileges commensurate with DO 909. (Refer to DO 909, Attachment A)

5.4 Phone Calls

5.4.1 All calls are provided and monitored consistent with DO 915.

5.4.1.1 I-5 inmates shall be permitted one telephone call per week of five minutes in duration.

5.4.1.2 Non I-5 inmates shall be permitted two phone calls per week of ten minutes in duration.

5.4.1.3 Level 4 inmates shall be permitted three phone calls per week of fifteen minutes in duration.

5.4.1.4 Level 3 inmates shall be permitted four phone calls per week of fifteen minutes in duration.

5.5 Visitation

5.5.1 Visits for I-5 and non I-5 inmates under this order will be non-contact, consistent with Department Order 911.

5.5.1.1 I-5 inmates shall be provided the opportunity for one visit per week, of two hours duration.

5.5.1.2 Non I-5 inmates shall be provided the opportunity for two visits per week, of two hours duration.

5.5.1.3 Level 3 and 4 inmates shall be provided the opportunity for two contact visits per week, of four hours duration.

5.5.1.4 The unit shall designate visitation days for each category of inmates.

5.6 Correspondence

5.6.1 All inmates under this order shall be permitted correspondence in accordance with DO 909.

5.7 Recreation

5.7.1 I-5 inmates shall be provided the opportunity for one hour of recreation three times per week.

5.7.2 Non I-5 inmates shall be provided the opportunity for ninety minutes of recreation three times per week.

5.7.2.1 Inmates who are double bunked will recreate with their cell mate.

5.7.2.2 Inmates in this status will be provided a sit-up bench, and upon request, a handball, volley ball, and/or exercise mat.

5.7.3 Level 4 inmates shall be provided the opportunity for two hours of recreation three times a week.

5.7.4 Level 3 inmates shall be provided the opportunity for two hours of recreation seven times a week.

5.8 Education

5.8.1 I-5 inmates shall be provided educational opportunities as follows:

5.8.1.1 Special Education

5.8.1.2 Section 504 of the Adults with Disabilities Act provides access to Education Programs for inmates with disabilities.

5.8.1.2.1 A schedule shall be made available upon request from the assigned CO III.

5.8.2 Non I-5 inmates shall be provided access to the following additional educational programs.

5.8.2.1 Mandatory Literacy.

5.8.2.2 GED via closed circuit TV and classroom.

5.8.2.3 Self study correspondence courses at the inmate's expense.

5.8.3 Level 3 and 4 inmates shall be provided access to the following additional educational programs.

5.8.3.1 Mandatory Literacy.

5.8.3.2 GED classes.

5.8.3.3 Community College classes.

5.8.3.4 Self study correspondence courses at the inmate's expense.

5.9 Religious Services

5.9.1 For I-5 and non I-5 inmates, cell front services shall be available at the request of the inmate. Pastoral services may be provided to inmates under this order via closed circuit TV where available. Religious visits may be conducted using the visitation stalls or at the inmate cell front.

5.9.2 Level 3 and 4 inmates shall be afforded religious services in a group setting.

5.10 Legal Access

5.10.1 All inmates under this order shall be provided legal access consistent with DO 902, by filing an inmate letter with the resource library.

5.11 Work Programs

5.11.1 I-5 inmates under this order shall not be eligible for work programs.

5.11.2 Non I-5 inmates shall be eligible for the following work programs:

5.11.2.1 Pod Porters

5.11.2.2 Outside Work Crews, Gun Gangs

5.11.3 Level 3 and 4 inmates will be eligible for all WIPP positions designated in accordance with Department Order 903.

5.12 Meals

5.12.1 All inmates under this order shall be provided meals in accordance with DO 912.

5.12.2 Staff shall take necessary precautions to assure there is no contamination or alteration of food for PS inmates.

5.13 Showers/Hygiene/Clothing

5.13.1 All inmates under this order shall be provided personal hygiene items, and clothing in accordance with DO 909.

5.13.2 All inmates under this order shall be provided Showers as noted below:

5.13.2.1 CDU, I-5 and non I-5 inmates under this order shall be afforded 3 showers per week.

5.13.2.1 Level 4 inmates under this order shall be afforded at a minimum 3 showers per week.

5.13.2.2 Level 3 inmates under this order shall be afforded a minimum of 3 showers per week.

5.14 Medical and Mental Health Services

5.14.1 All inmates under this order shall be provided access to medical and mental health services in accordance with DO 1101.

5.15 Administrative Oversight

5.15.1 Management Personnel shall randomly tour housing units confining PS inmates, at a minimum, in accordance with the following schedule:

Warden One time per month

Deputy Warden One time per week

Chief of Security Twice per week

Shift Commander Once per shift

Facility Health Administrator One time per month

CO IV Two times per week

Food Service Liaison Observe a breakfast, a lunch or a dinner being served once per week.

Chaplain Once per week

Education CEPM Once per month

6.0 IMPLEMENTATION: This Director's Instruction shall be effective immediately.
