In the interest of public safety and as provided for by Arizona Revised Statute 13-3821B, the Arizona Department of Corrections may apply the requirements for sex offender registration to identified inmates prior to their release from prison to assist in the timely dissemination of sex offender release information to law enforcement agencies.
The following process shall be independent of the current procedures in place for the entry of sex offender release information into the Arizona Criminal Justice Information System's Sex Offender Profile and Notification database for all inmates convicted of sex offenses.
The Sex Offender Coordination Unit shall identify sex offenders who were convicted of one or more of the predicate offenses enumerated in A.R.S. §13-3821 (A) and who meet the following criteria:
- Inmates designated as Sexually Violent Persons for whom a civil commitment petition has been submitted under A.R.S. § 36-3701 et. seq.
- Inmates who are released under the supervision of Arizona Department of Corrections Parole Officers or county probation officers within Arizona.
- Inmates whose digitized fingerprints are on record in the Arizona Automated Fingerprint Identification System (AZAFIS).
- Inmates whose digitized photo images are on record in the Mug Photo Interface system (MPI).
- Inmates whose Adult Inmate Management System (AIMS) record contains a State Identification (SID) number issued by the Arizona Department of Public Safety and an FBI number issued by the Federal Bureau of Investigation.
- Any other criteria as determined by the Administrator of the Criminal Justice Support Bureau.
Upon identification of an inmate who is subject to registration as outlined in this instruction, the Sex Offender Coordination Unit supervisor or designee shall:
- Complete an Arizona Department of Public Safety Sex Offender Registration form and identify the registration as either an Initial Registration, Updated Registration or Change of Address, in the upper left corner of the form.
- Forward the registration form to the Offender Information Unit (OIU) supervisor of the institution where the inmate is housed no later than 10 days prior to the inmate's anticipated release date.
The OIU supervisor shall:
Present the form to the inmate for signature and advise them that:
- Registration is lawfully required under Arizona Revised Statutes 13-3821.
- Registering while in ADC custody will relieve the inmate of the requirement to register with the local sheriff within 10 days after release.
- After initial registration, they will be required to notify the local sheriff in their county of residence of any address changes.
Provide a copy of the form to the inmate after signature.
If the inmate refuses to sign, write "Refused to Sign" on the inmate signature line and return the form to the Sex Offender Coordination Unit without further action.
Attach a copy of the inmate's digitized fingerprint images from the AZAFIS system to the signed registration form and return it to the Sex Offender Coordination Unit no later than the next business day.
The Sex Offender Coordination Unit supervisor or designee shall:
Review the registration documents and digitized fingerprints for accuracy and make two additional copies of the materials.
Print three color photos of the inmate from the Mug Photo Interface System and attach one to each packet prepared. Packets are to be distributed as follows:
Original: To be forwarded via certified mail to the Arizona Department of Public Safety, Criminal History Records Section, Attn: Sex Offender Registration.
Copy #1: To be forwarded via certified mail to the records section of the sheriff's office in the Arizona county in which the offender intends to reside after release from imprisonment.
Copy #2: To be retained in the files of the Sex Offender Coordination Unit with all other materials pertaining to the inmate, including the date the original and copies were mailed to the above agencies.
Ensure that the registration packets are forwarded to the Arizona Department of Public Safety and the sheriff's office in the county where the inmate intends to reside no later than the next business day after the inmate's release from the Arizona Department of Corrections custody.
If the sex offender is to be supervised after release, the Sex Offender Coordination Unit supervisor or designee shall ensure written notification is made to the appropriate parole or probation officer that the offender has been registered by mailing a copy of the registration document, fingerprints and photo to the supervising officer.
The Sex Offender Coordination Unit supervisor shall ensure the offender's AIMS record is appropriately annotated during each step of the registration process until completed.
