MINUTES OF PUBLIC MEETING
FOR CORRECTIONS OFFICER RETIREMENT PLAN LOCAL BOARD
ARIZONA DEPARTMENT OF CORRECTIONS
A Public meeting of the Corrections Officer Retirement Plan
Local Board for the Department of Corrections was convened, Wednesday, November
22, 2006, at 9:00 a.m., in the Human Services Building, 1831 West Jefferson,
Second Floor Conference Room, Phoenix, Arizona.
Present at the meeting were the following individuals:

I. Call to Order – Local Board meeting called to order by
P. Scherden, Chair, at 9:04 a.m., Wednesday, November 22, 2006.
II. Approval of Minutes
a. October 25, 2006, Public Meeting Minutes – A
motion for approval was made by B. Rollins. Seconded by R. Burgher.
Approved.
III. Disability Retirement – The Local Board may consider
and vote on the following disability applications in Public Session or the Board
may defer this decision to a later date. The Local Board may vote to discuss
these applications in Executive Session pursuant to A.R.S. 38-431.03 (A)(2) and
obtain legal advice pursuant to A.R.S. 38-431-03 (A)(3).
a. #06-01 – Re-hearing – Mr. Bihn, applicant’s
attorney, presented the Local Board Chair with the signed waiver of
confidentiality. The Local Board denied Accidental Disability Retirement
benefits on June 22, 2006, after review of an independent medical evaluation
report submitted by the Local Board’s physician Dr. Thrasher, dated June 2,
2006, and medical documentation and institution reports submitted by the
applicant relating to the alleged injuries. No additional medical
documentation was provided by the applicant to the Local Board at the
re-hearing. The Chair stated to the applicant’s attorney that the burden of
proof was on the applicant. Mr. Bihn agreed and stated the applicant would
testify and he would point out certain aspects in the applicant’s disability
file. After hearing and questioning the applicant’s timeframe of events
before and after her employment with the Department and review of medical
reports provided by Dr. Thrasher, the pre-employment examination, and the
applicant’s doctor reports, the Board determined to deny the re-hearing
request for Accidental Disability. A motion for denial was made by R.
Burgher. Seconded by B. Rollins. Approved.
IV. Normal Retirements – The Local Board may consider and
vote on the following applications for Normal Retirement in public meeting or
defer decision to a later date. A motion for approval of the following (6)
Normal Retirement Applications (a – f) was made by B. Rollins. Seconded
by R. Burgher. Approved.

b. Terri L. Daniel
c. Linda K. Melendez
d. Madeleine C. Perkins
e. Adolph A. Sanchez, III
f. Morton M. Spizer
V. Death Benefit – The Local Board may consider and vote
on the following Requests to Remain in ASRS/CORP in the Public Meeting or defer
decision to a later date. The Local Board may vote to discuss these applications
in Executive Session pursuant to A.R.S. 38-431.03 (A)(2) and obtain legal advice
pursuant to A.R. S. 38-431-03 (A)(3).
a. Robert Hobley (Dora Sedleck) – Chair noted for
record.
VI. General Discussion – The Local Board may consider and
vote on the following Job Classifications in the Public Meeting or defer
decision to a later date.
a. Class Code (AUN07428) – DC Corrl Educ Ops Admr – A
motion was made to remove this item from the table by R. Burgher. Seconded
by B. Rollins. B. Rollins made a motion to deny this position as a CORP
designated position. Seconded by R. Burgher. Denied.
VII. Call to Public
Meeting adjourned at 9:46 a.m.
