CORRECTIONS OFFICER RETIREMENT PLAN LOCAL BOARD FOR
ARIZONA DEPARTMENT OF CORRECTIONS

A Public meeting of the Corrections Officer Retirement Plan Local Board for the Department of Corrections was convened Tuesday, April 8, 2008, at 9:00 a.m, in the Human Services Building, 1831 West Jefferson, Second Floor Training Room, in Phoenix, Arizona.

Present at the meeting were the following individuals:

  1. Call to Order – Local Board meeting called to order by P. Scherden, Chair, at 9:13 a.m., Tuesday, April 8, 2008.
  2. Approval of Minutes – A motion for approval of Wednesday, March 12, 2008 Public Meeting Minutes and Executive Session Minutes was made by R. Burgher and seconded by P. Scherden. Approved unanimously.
  3. Disability Retirement – None
  4. Normal Retirements – The following applications were presented for consideration of retirement effective as stipulated below:
    1. April 1, 2008 – A motion to approve items 1-11 was made by R. Burgher and seconded by M. Proto. Approved unanimously.

    2. May 1, 2008 – A motion to approve items 1-2 was made by R. Burgher and seconded by W. Woolsey. Discussion: R. Burgher inquired as to disparate salaries from one fiscal year to the next. Secretary explained that these occasionally occur as a result of promotions, raises, or cost of living increases. Approved unanimously.

  5. Survivor Benefits – The following applications were presented for consideration. A motion to table Item d. was made by R. Burgher and seconded by M. Proto. Discussion: Secretary informed the Board that the completed documents had not yet been received from the applicant. Approved unanimously.
    A motion to approve items a-c, e-f was made by M. Proto, contingent upon receipt of appropriate certificates in the case of items c. and e., and seconded by W. Woolsey. Approved unanimously.

  6. Death Benefits – The following application was presented for consideration. Motion to approve item a. was made by M. Proto, contingent upon receipt of a death certificate, and seconded by R. Burgher. Approved unanimously.

  7. Request to Remain in ASRS/CORP – The following waivers have been filed and are presented for Local Board consideration. A motion to remove item a. from the table was made by R. Burgher and seconded by B. Rollins. Motion to approve items a-b was made by M. Proto and seconded by W. Woolsey. Approved unanimously.

  8. General Discussion – Items may be discussed/voted on by the Board. At any time, the Board may enter into Executive Session pursuant to A.R.S 38-431.03 (A)(2) and obtain legal advice pursuant to A.R.S 38-431.03 (A)(3) to discuss details of a serious or confidential nature.
    1. Temporary waivers to remain in CORP – Secretary provided a list of active waivers that are greater than 2 years since receiving Board approval. Input was solicited as to the intentions of the Board in dealing with waivers that may appear to exceed the spirit and intent of the statutes. M. Turner provided copies of ARS 38-891.E, with emphasis upon the word “transferred” (as opposed to promoted or laterally moved). R. Burgher related previous Board discussions with intent to create more definitive guidelines. The Board does not intend to penalize employees for promoting into non-designated positions. B. Rollins stressed the importance of balancing the Board’s ability to be compliant with statute, consistent with the membership, and mindful of the impact these decisions have on the group as much as on the individual. Secretary inquired if it was appropriate to assign a review date for non-designated positions. B. Rollins expressed a need for periodic reviews of the list. This will serve the membership while maintaining the best interests of the plan.
      R. Burgher paraphrased the remarks of a previous Board Member, J. Hood, in stating the Board’s requirement to do what is right without hamstringing the course of the Director. Furthermore, he recommended that reminders be added to approval letters. Recipients of CORP waivers shall be informed that additional moves into non-designated positions are NOT covered by the initial request. Each move is to be treated separately, with appropriate submission of documents
    2. CORP Training – Coordinators/Board Members have been approved for refresher training presented by the Fund Manager on April 25, 2008.
    3. Pool Nurses – Secretary advised that three (3) employees originally hired (in 2000-2001) as “temporary” or “seasonal” began contributions to CORP. These employees were not eligible under ARS 38-881.14 membership rules as they were not “full time.” CORP will calculate and refund all contributions to those employees. Secretary will ensure Personnel has notified the affected employees.
  9. Call to Public – No items.
