FOR CORRECTIONS OFFICER RETIREMENT PLAN LOCAL BOARD
ARIZONA DEPARTMENT OF CORRECTIONS

A Public meeting of the Corrections Officer Retirement Plan Local Board for the Department of Corrections was convened Tuesday, October 7, 2008, at 9:00 a.m., in the Human Services Building, 1831 West Jefferson, Second Floor Training Room, in Phoenix, Arizona.

Present at the meeting were the following individuals:

Absent: James O’Neil, Board Member

  1. Call to Order – Local Board meeting called to order by P. Scherden, Chair, at 9:05 a.m., Tuesday, October 7, 2008.
  2. Approval of Minutes – A motion for approval of Wednesday, September 10, 2008 Public Meeting Minutes was made by R. Burgher and seconded by W. Woolsey. Approved unanimously.
  3. Disability Retirement – None.
  4. Normal Retirements –The following applications have been filed and are presented for Local Board consideration:
    1. October 1, 2008 –A motion to approve items 1 – 2 was made by R. Burgher and seconded by M. Proto. Approved unanimously.

    2. November 1, 2008 – A motion to approve items 1-4 was made by R. Burgher and seconded by M. Proto. Approved unanimously.

      4. Joseph S. Profiri
  5. Survivor Benefits – None.
  6. Death Benefits – The following application has been filed and is presented for Local Board consideration. A motion to approve was made by M. Proto and seconded by W. Woolsey. Approved unanimously.

  7. Request to Remain in ASRS/CORP – Request to Remain in ASRS/CORP – The following application has been filed and is presented for Local Board consideration. Based on 14 years of credited service, and over 20 years with the agency, a motion to approve was made by R. Burgher and seconded by M Proto. Prior to discussion, the Chair made a motion at 9:25 a.m. to Table until a vote could be completed on Item VIII.a. Seconded by R. Burgher. At 9:33, a motion to Remove from the Table was made by R. Burgher and seconded by W. Woolsey . The previous motion to Approve this application was approved unanimously.

  8. General Discussion – General Discussion – Items may be discussed/voted on by the Board. At any time, the Board may enter into Executive Session pursuant to A.R.S 38-431.03 (A)(2) and obtain legal advice pursuant to A.R.S 38-431.03 (A)(3) to discuss details of a serious or confidential nature.
    1. Class Code (AUN 09005) – Administrative Services Officer IV. At 9:25 a.m., a motion to Exclude this code from CORP participation was made by R. Burgher and seconded by the Chair. Discussion: R. Burgher reiterated numerous points discussed in April 1, 2008 Public Meeting. Specifically, the Assistant Attorney General’s guidance to follow statutes despite a lack of a definitive explanation of the intent for a “temporary” transfer. W. Woolsey added that the additional administrative burden would multiply with the increased potential for appeals. He also offered to approach Division Directors to see what feedback may have been given when former Board Member B. Rollins presented the Fund Manager’s concern with the lengthy duration of certain waivers. The motion to Exclude was approved unanimously.
    2. Class Code (AUN 07575) – DC Legislative Liaison. A motion to Exclude this code from CORP participation was made by R. Burgher and seconded by W. Woolsey. Approved unanimously.
    3. 2009 Board Meeting Schedule – Chair provided preliminary dates for 2009. Secretary will disseminate and provide further updates for discussion. Once the Pre-Retirement Seminar schedule is published by ADOA, dates for Board Meetings in Tucson may be coordinated
  9. Call to PublicSecretary provided a status update on the CORP Board Member election. The quantity of ballots received has already exceeded the election of two years ago by over 400 votes.
